Practice Area Definitions

Alternative Dispute Resolution:

Alternative Dispute Resolution is also know as ADR. It could be one of a number of different tools used by someone appointed by parties to help them settle their dispute without having to go to court. Mediation is one of the more widely known forms of ADR. In addition, alternative dispute resolution methods include negotiations, settlement conferences, and arbitration.

Mediation:

Mediation is the process in which a neutral third party (mediator) assists the conflicting parties to come to an agreement between them. Mediators are usually highly skilled, and highly trained in the process of mediation.

Securities Fraud:

Securities investing and trading is carefully regulated by rules and laws for the protection of public investors. The violation of these rules, particularly through various deceptive actions and schemes to cheat or take advantage of investors, is commonly known as securities fraud.

Real Property:

Property signifies dominion or right of use, control, and disposition which one may lawfully exercise over things, objects, or land. One of the basic dividing lines between property is that between real property and personal property. Generally, the term real property refers to land. Land, in its general usage, includes not only the face of the earth but everything of a permanent nature over or under it. This includes structures and minerals.

Excessive Force:

Any degree of force that is more than is objectively reasonable.

Police Brutality:

A law enforcement officer has the right to use such force as is reasonably necessary under the circumstances to make a lawful arrest. An unreasonable seizure occurs when a law enforcement officer uses excessive force in making a lawful arrest.

Sexual Harassment:

The area of law dealing specifically with discrimination consisting of unwelcome verbal or physical conduct directed at an employee because of his or her sex.

Discrimination:

The area of law dealing with unfair or unequal treatment of a person or persons based upon their belonging to a protected class.

Age Discrimination:

Sex Discrimination:

Race Discrimination:

The area of law dealing with unfair or unequal treatment of a person or persons based upon their race.

Religious Discrimination:

Americans with Disabilities (ADA):

The Americans with Disabilities Act (ADA) prohibits discrimination against qualified disabled individuals in all employment practices including job application procedures, hiring, promotion and advancement, discharge compensation, training and other terms, conditions and privileges of employment.

Employer Liability under the Title VII for Sexual Favoritism:

EEOC's Guidelines define two kinds of sexual harassment: "quid pro quo," in which "submission to or rejection of [unwelcome sexual] conduct by an individual is used as the basis for employment decisions affecting such individual," and "hostile environment," in which unwelcome sexual conduct "unreasonably interfer[es] with an individual's job performance" or creates an "intimidating, hostile or offensive working environment."

Failure to Hire or Promote:

Failure to hire, promote, or treat a person equitably due to race, color, religion, sex, national origin, age, or disability.

Wrongful Termination:

An employee cannot be fired if to do so would violate "fundamental public policy" which would include firing someone based on age discrimination, race discrimination, and for other similar reasons.

Business & Partnership Disputes:

Conflicts that arise from or through business and/or partner relationships.

Wage & Hour Claims:
